1. About this service
ListingDraft (“we”) provides an informational service that helps former homeowners determine whether they may be owed surplus funds from a foreclosure sale and connects them with licensed attorneys in their state who can file the claim. ListingDraft is not a law firm and does not provide legal advice.
2. Our service is free; attorneys work on contingency
You will never be asked to pay ListingDraft any fee. If you choose to engage an attorney through our service, that attorney works on a contingency-fee basis: a percentage of any funds recovered, disclosed in writing before you sign the engagement agreement. If no funds are recovered, you owe the attorney nothing.
3. No guarantee of recovery
Not every foreclosure generates surplus funds, and not every claim succeeds. Even when surplus funds exist, other parties (junior lienholders, homeowners’ associations, etc.) may have priority claims that reduce or eliminate the share available to the former owner. We make no guarantees about the outcome of any claim.
4. Attorney–client relationship
Any attorney–client relationship is between you and the attorney you choose to engage — not with ListingDraft. The attorney is independently licensed and responsible for the legal representation. Communications with ListingDraft are not protected by attorney–client privilege.
5. Accuracy of information
You agree to provide accurate, complete information when using our service. Submitting false information or attempting to claim funds you are not entitled to may be a crime and will result in termination of service.
6. Eligibility
You must be at least 18 years old and have legal capacity to enter into a contract. If you are claiming on behalf of an estate or deceased family member, additional documentation will be required.
7. Communications
By submitting a claim form, you authorize ListingDraft and our partner attorneys to contact you about your inquiry using the methods (email, phone, mail) you provided. You may withdraw consent at any time.
8. Limitation of liability
To the maximum extent permitted by law, ListingDraft is not liable for indirect, incidental, or consequential damages arising from your use of this service. Our total liability to you for any claim related to this service is limited to the amount you paid us (which is typically zero).
9. Changes to these terms
We may update these terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the service after changes constitutes acceptance.
